Privacy Policy

Blue Neon is a consultancy. We don't run consumer accounts, we don't track you across the web, and we don't sell anyone's data. This policy explains the personal information we do handle, why we hold it, and how to get at it.

About this policy

We're Blue Neon, a Sydney consultancy. This policy sets out how we handle personal information.

We're Blue Neon Pty Ltd (ABN 52 697 879 119), an Australian company based in Sydney, Australia. In this policy, “we”, “us” and “our” mean Blue Neon Pty Ltd.

It applies to personal information we collect through blueneon.com.auand in the course of our work with clients, suppliers, partners and job applicants. “Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether it is true or not.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy doesn't cover sites we link to — their own policies apply there.

Section 2

What we collect

Contact details you give us, the correspondence and material that comes out of an engagement, and standard web server logs.

Information you give us

  • Enquiries. When you use the form on our contact page or email us, we collect your name, email address, company, and whatever you put in the message.
  • Client, supplier and partner contacts. Names, roles, business contact details and correspondence for the people we work with.
  • Engagement material.Documents, data and systems access a client gives us to do the work. This sometimes contains personal information about a client's own staff or customers. Where it does, we handle it under the terms of our contract with that client, and only for the purposes of the engagement.
  • Job applications. If you apply to work with us: your CV, work history, qualifications and referee details.

Information collected automatically

Our website host records standard server logs — IP address, browser and device type, pages requested and timestamps. We use these to keep the site up and secure. We don't use them to build profiles of visitors.

Sensitive information

We don't ask for sensitive information (health, biometric, racial or ethnic origin, political or religious views, and the like) through this website. Where an engagement in a regulated sector genuinely requires us to handle it, we do so only with the consent or legal authority the client has obtained, and under the controls agreed for that project.

Why we collect it

To reply to you, to deliver the work, to keep the site running, and to meet our legal obligations.

  • To respond to your enquiry and talk to you about your project.
  • To scope, deliver, support and invoice our services.
  • To manage our client, supplier and partner relationships.
  • To assess job applications.
  • To keep our website and systems secure, available and working.
  • To send occasional updates to people who've asked for them (see Marketing).
  • To meet legal, tax, insurance and record-keeping obligations, and to establish or defend legal claims.

If you don't give us the information we ask for, we may not be able to reply to you or provide our services.

Section 4

Who we share it with

A small set of service providers, plus professional advisers and regulators where we have to. We don't sell your data.

We don't sell personal information, and we don't disclose it to third parties for their own advertising or marketing.

If our business is ever restructured, sold or merged, personal information may be transferred to the acquiring party as part of that transaction, subject to this policy.

Section 5

Overseas disclosure

Some of our service providers store data outside Australia, mainly in the United States.

Web3Forms and our email, file storage and hosting providers may store or process information in the United States and other countries where they operate data centres.

Before using an overseas provider we take reasonable steps to satisfy ourselves that it will handle personal information in a way consistent with the APPs — through its contractual commitments, published security practices and privacy certifications. We can't control every action of an overseas recipient, and foreign laws may differ from Australian privacy law.

Section 6

Security and retention

Encryption in transit, access limited to people who need it, and we delete what we no longer need.

How we protect it

Our website is served over HTTPS and form submissions are encrypted in transit. Access to mailboxes and project systems is limited to the people who need it, protected by strong authentication. No system is perfectly secure, but we take reasonable steps to protect information from misuse, loss, and unauthorised access, modification or disclosure.

How long we keep it

  • Enquiries that don't become engagements: up to 2 years, then deleted.
  • Client records: for the life of the relationship and then 7 years, to meet tax, contractual and limitation-period obligations.
  • Client engagement material: returned or securely destroyed at the end of the engagement, unless the contract says otherwise.
  • Unsuccessful job applications: up to 12 months, unless you ask us to keep them on file.

Data breaches

If a data breach happens that is likely to result in serious harm, we'll notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by the Notifiable Data Breaches scheme.

Section 7

Cookies and analytics

This site sets no cookies and runs no analytics or advertising trackers.

blueneon.com.au doesn't set cookies, use local storage, or run analytics, advertising or session-recording scripts. Our fonts are served from our own domain, so loading a page doesn't send a request to a third-party font service.

We do verify the site with Google Search Console, which reports aggregate search statistics — how often pages appear in results and which queries lead to them. It doesn't identify individual visitors to us.

If we add analytics later, we'll update this policy before turning it on.

Section 8

Marketing

We only email people who've given us their details, and every message has a way out.

We may occasionally send updates about our work to clients and to people who have contacted us or asked to hear from us. Every message includes an unsubscribe option, and you can opt out at any time by emailing hello@blueneon.com.au. We'll act on it promptly. We don't buy marketing lists or send commercial messages to people who haven't asked for them.

Section 9

Your rights

Ask us for a copy of what we hold, ask us to fix it, or complain — starting with us, then the OAIC.

Access and correction

You can ask us for a copy of the personal information we hold about you, and ask us to correct anything inaccurate, out of date or incomplete. Email hello@blueneon.com.au. We'll ask you to verify your identity and respond within 30 days. There's no charge, though we may charge a reasonable cost for large or complex requests — we'll tell you before we do. If we refuse access or a correction, we'll explain why in writing.

If we hold personal information about you on behalf of a client, the quickest route is usually a request to that client, who controls the data. Contact us and we'll point you the right way.

Deletion

You can ask us to delete personal information we hold about you. We'll do so unless we're required to keep it — for example, tax records or an active contract.

Complaints

If you think we've mishandled your personal information, email hello@blueneon.com.auwith the details. We'll acknowledge your complaint within 5 business days and aim to resolve it within 30 days. If you're not satisfied with our response, you can take it to the OAIC: oaic.gov.au or 1300 363 992.

Section 10

Changes to this policy

We'll post any updates here and move the date at the top.

We may update this policy as our business or the law changes. The current version always lives at this address, with the version number and effective date at the top. Material changes will be flagged clearly on this page.
